1. Personal data administrator

The controller of your personal data is eLeader Sp. z o. o. with its registered office in Lublin at 16 Nałęczowska Street, 20-701 Lublin, entered into the Register of Entrepreneurs of the National Court Register under the KRS number 0000193608, NIP 713-258-93-06, REGON 431273170 (« Controller »).

Personal data will be processed in accordance with the Act of 10 May 2018 on the Protection of Personal Data (Journal of Laws of 2018, item 1000) and Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to in the document as « GDPR »).

2. What data do we process and why?

We primarily receive personal data when you contact us via the eleader.biz website, forms available on other websites, such as LinkedIn, or directly – by email, phone, or other means. The data we process depends on the form and purpose of the contact. Typically, these include your name, work email address, phone number, company name, job title, and information provided in the message or form. We may also process information regarding consents granted and data related to your use of the website.

We use data for the following purposes:

• handling inquiries via the contact form – if you contact us regarding a contract that you may enter into in person, we process your data to take steps prior to its conclusion (Article 6(1)(b) of the GDPR). If you are acting on behalf of a company or other entity, the basis for processing is our legitimate interest in conducting business communications and handling your inquiry (Article 6(1)(f) of the GDPR);
• preparing an offer and conducting discussions regarding our products or services – the basis for processing is Article 6(1)(b) of the GDPR, when the discussions concern a contract that you are to conclude in person, or Article 6(1)(f) of the GDPR, when you represent or act on behalf of another entity;
• sending commercial information, including the marketing of our products and services – sending offers, newsletters, mailings, eLeader promotional materials and other marketing and sales information using electronic means of communication – based on voluntary consent (Article 6(1)(a) of the GDPR in connection with Article 398 of the Electronic Communications Law) or the legitimate interest of the controller (Article 6(1)(f) of the GDPR).
• sending commercial and marketing information in a form other than electronic – the legal basis for processing is the legitimate interest of the controller (Article 6(1)(f) of the GDPR), consisting in the promotion of the services offered.
• registration for events and webinars – handling registration processes, participation, and the ongoing organization of conferences, training sessions, online meetings, and webinars organized by the controller. The legal basis for data processing is voluntary consent (Article 6(1)(a) of the GDPR);
• ensuring the operation and security of the eleader.biz website, including preventing abuse and determining, pursuing and defending against claims – based on our legitimate interest (Article 6(1)(f) of the GDPR);
• analysis of website use – if we use tools requiring consent for this purpose, we process data on the basis of consent (Article 6(1)(a) of the GDPR).

Providing your data is voluntary. However, without the data needed to process your inquiry, we may not be able to respond, contact you, or schedule a presentation.

3. How long do we store data?

We store data for the period necessary to achieve the purpose for which it was collected.

If you contact us regarding a presentation, offer, or potential collaboration, we process your data for the duration of the conversation. After the conversation ends, we may retain information needed to demonstrate the course of the conversation or to secure any claims for a period justified by applicable law and our legitimate interest. We process data used for marketing purposes based on a legitimate interest until you object to such processing or until we terminate our marketing activities towards the person in question. If a specific form of marketing contact requires consent, we use it until such consent is withdrawn.

4. Who can receive the data

We don’t handle all website management, sales, or contact management ourselves. In this respect, we use the services of external suppliers and – when necessary – we provide them with personal data based on a personal data processing agreement.

The recipients of data may be, in particular:

• providers of IT services, hosting and IT infrastructure;
• providers of e-mail, CRM systems and tools used to handle sales, marketing and business contacts;
• providers of analytical, marketing and website security tools;
• entities providing us with legal, accounting or advisory services;
• public authorities or other entities, if the obligation to provide data results from legal provisions.

Due to the use of certain technological services, data may also be processed outside the European Economic Area. In such cases, we ensure that the data is transferred in accordance with the GDPR. Depending on the country and the provider, this may take place, in particular, on the basis of a European Commission decision establishing an adequate level of protection or Standard Contractual Clauses approved by the European Commission.

5. Your rights

In connection with the processing of personal data, you may – in accordance with the principles set out in the GDPR – request:

• access to your data;
• their corrections;
• deletion of data;
• restrictions on their processing;
• data portability if the data is processed based on consent or in connection with a concluded contract and when the processing is carried out by automated means. If we process data based on our legitimate interests, you may also object to such processing. In the case of data used for direct marketing, you may object to such processing at any time. Upon receipt of an objection, we will no longer process your data for that purpose.

If data processing is based on consent, you may withdraw it at any time. Withdrawing consent does not affect the lawfulness of the processing we carried out prior to its withdrawal. This also applies to consent to marketing contact via a specific communication channel – such consent may also be withdrawn at any time.

6. Cookies and similar technologies

The eleader.biz website uses cookies and similar technologies. Some of them are necessary for the site to function properly, ensure its security, or provide a feature you have requested. To the extent that consent is not required for such technologies, they may be activated from the moment you enter the site. We activate other technologies, particularly those used for analytical or marketing purposes, after obtaining consent.

If we use tools provided by third parties, their providers may receive information about the device you are using and your activity on the website – to the extent resulting from the operation of the tool and selected cookie settings. Cookies are used for the following purposes:

a) Tailoring website content to your preferences and optimizing website usage; in particular, these files enable the recognition of your device and the display of the website in a manner adapted to your individual needs,

b) Creating statistics that help us understand how you use websites, which allows us to improve their structure and content.

You can change your cookie preferences at any time using the settings available on the website. You can withdraw your previously granted consent at the same time.

7. Automated decision-making and profiling

We do not use the data collected via the eleader.biz website or in connection with your contact with us to make decisions about you based solely on automated processing, including profiling, that would produce legal effects or significantly affect you in a similar way.

8. Changes to the Privacy Policy

We may update this Policy if the way we process data, the tools we use, or applicable laws change.
